One of the most common environmental services provided by Basin is the creation and maintenance of a Spill Prevention Control and Countermeasure (SPCC) plan for facilities subject to the federal regulation. We have created thousands of SPCC plans that meet and exceed regulatory standards.

Who needs an SPCC plan?

If you store oil or petroleum products at your facility you may need an SPCC plan. Federal regulations 40 CFR 112 contain the Oil Pollution Prevention requirements. 

Essentially, if your facility stores more than 1,320 gallons of oil or petroleum products above ground, you need to have an SPCC plan.  

There are many facilities that fall within the scope of the regulation - even if they aren’t related to the production of petroleum products. 

These could include large farms or other agricultural facilities, industrial facilities with large storage tanks, public facilities such as airports, hospitals, or even commercial facilities like car dealers.

Not knowing you are subject to the law doesn’t exempt you from the law 

According to the EPA, many small facilities and facilities that had been purchased and not yet established a plan represent the most common violations of the law. 

Both can be subject to fines or other enforcement action.

Facilities with large storage containers are required to have an SPCC plan in place. 
What does an SPCC plan do?
The intent is to identify facility risks that could lead to accidental discharge of oil, manage those risks and define steps to be taken in the event of discharge or spill. 

The ‘Countermeasure’ part of the plans details steps that will be taken to quickly stop a discharge and clean up any resulting spill damage.  

Does an SPCC plan need to be registered or filed?

The plan does not have to be registered or filed with the EPA, however, you are expected to have the plan readily available to present to an EPA inspector upon request. 

Facilities conducting drilling operations may be required to have an SPCC plan in place. 

A typical SPCC plan contains the following information

  • Basic information about the facility
  • Information about the type of petroleum products stored
  • Emergency information – who to call, what steps to take
  • Procedures for fueling and filling – includes who, how and when 
  • Current facility spill prevention details
  • Spill plan deficiencies and needed improvements
  • Checklists to guide monthly self-inspections
  • Regular plan review and training – instructions for both
  • Other relevant documents
  • Variances to plan – what to do if you are unable to comply with the plan

How does Basin create an SPCC plan?

Initial assessment
The first step to creating an effective plan is to evaluate your facility and understand your operations. The facility size and degree of complexity will dictate what needs to be included in the SPCC plan.  

On-site Inspection 
The Basin Environmental Consultant will begin by having a conversation with you or a designated member of your team. They will ask a series of questions as part of an initial assessment. 

This is usually followed by an on-site inspection of the covered facilities. The inspection will help identify any potential regulatory violations to be addressed as well as risk factors that could lead to potential leaks or spills.  

Address deficiencies
If your operation doesn’t have the resources needed to address any facility discrepancies, your Basin Consultant can provide an estimate for services to bring the facility into environmental compliance. 

Create plan
There are three primary types of spill plans. The type of spill plan you need is determined by a few variables like any spill history at your site, the amount of oil you store and the size of storage containers. 

Our consultants will know which plan is needed based on the results of the initial assessment and on-site inspection. 

Keep in mind that separate facilities require separate plans. So if you have a well and tank battery in one county and one in a different part of the same county, you will need two separate SPCC plans. 

Your plan will contain several sections each containing specific information about your facility and operations. The more complex your facility and operation, the more information there will be in your plan.
